1. Acceptance of Terms

By accessing and using thisisforyou.love ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

We provide a web-based platform that allows users to create personalized digital greetings and web experiences ("Tributes") incorporating user-uploaded photos, names, and messages, enhanced by our templates and music.

3. User Content & Conduct

You retain full ownership of any photos, text, or other content you upload. By uploading content, you grant us a worldwide, non-exclusive license to use, reproduce, and display such content solely for the purpose of providing the Service to you (i.e., generating your Tribute).

You agree NOT to upload content that:

• Is illegal, threatening, defamatory, or pornographic.
• Infringes on the intellectual property rights of others.
• Contains malware, viruses, or harmful code.

We reserve the right to remove any content or terminate accounts that violate these terms.

4. Payments & Refunds

Pricing: Prices for our services are listed on the website and are subject to change without notice. All prices are displayed in USD.

Taxes: For customers located in Canada, a 5% Goods and Services Tax (GST) will be applied to the purchase price at checkout. Customers in all other countries are not charged any additional taxes. The applicable tax amount will be clearly displayed before you complete your payment.

Refunds: Due to the immediate, personalized, and digital nature of our products, we generally do not offer refunds once a project has been generated. However, if you experience a technical failure or are unsatisfied with the result due to a system error, please contact us for a full resolution or refund.

5. Service Duration & Hosting

Each Tribute created on our Service includes clear hosting until February 28, 2026. After this date, links to Tributes will expire, and the associated content may be permanently deleted. We recommend saving any important messages or screenshots during the hosting period.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted or error-free. We make no warranties, expressed or implied, regarding the quality, accuracy, or reliability of the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall thisisforyou.love, its affiliates, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months prior to the event giving rise to the liability, or CAD $100, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless thisisforyou.love, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any content you upload or share through the Service

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the courts of British Columbia, Canada, and you irrevocably submit to the jurisdiction of such courts.

10. Dispute Resolution

Before filing any formal legal action, you agree to first contact us at support@thisisforyou.love to attempt to resolve the dispute informally. We commit to working with you in good faith to reach a mutually acceptable resolution.

If we cannot resolve the dispute within 30 days, either party may pursue formal legal remedies in accordance with the Governing Law section above.
